An Antenuptial Agreement is entered into wherein the parties do not wish to get married in community of property.
By signing an ANC, you and your spouse are deciding on your future and how assets should be divided should one of you pass away and or your marriage comes to an end.
- A prenuptial agreement can make a big difference in situations such as:
- People who already own assets such as businesses, and family obligations like children before wedding.
- For instance, the contract ensures that partners retain their separate estates and are not liable for each other’s debts for instance, unless they have taken out the debt jointly or a spouse provided personal security for the debt of the other spouse.
Antenuptial Agreement with Accrual.
If the parties enter into the agreement with the accrual system, each party retains his or her own estate, but the agreement determines how the growth in each partner’s estate will be shared.
The accrual takes effect when the marriage ends – because of divorce or death. You cannot make a claim for the accrual while the marriage still subsists.
The person with the lowest income has a claim against the others, Spouse’s property.

Without the Accrual
If the ANC is without the accrual, the partners keep what is theirs before marriage and keep what becomes theirs after and or during the course of the marriage.
